Smoke Alarm vs Smoke Detector: Two Different Things in Ontario Law

They are not the same device and Ontario law does not treat them as the same device. A smoke alarm is self-contained: it senses smoke and sounds the alarm itself, at the device. A smoke detector is an initiating device that forms part of a fire alarm system. They are built to different standards — CAN/ULC-S531 and S553 for smoke alarms, CAN/ULC-S524 and S537 for detectors on a system — and once installed they fall under different parts of the Fire Code. Testing a smoke alarm is the landlord pressing the test button. Testing a smoke detector on a fire alarm system requires a person who has completed a program or course acceptable to the Fire Marshal. Same-looking disc on the ceiling, completely different legal regime.

One caveat about the Building Code text

Ontario's Building Code is now O. Reg. 163/24, in force 1 January 2025. It is one page long. It adopts NBC 2020 as amended by the "Ontario Amendments to the National Building Code of Canada 2020," and the amendment document actually in force is dated 17 July 2026. MMAH does not publish that document online — it is sent on email request only, from Ontario.Amendment.Document@ontario.ca.

The free text you can open right now is the 2024 Building Code Compendium Vol. 1, the January 16, 2025 Update. That consolidation sits four amendment-document versions behind the one in force. Every Building Code quotation below is from it. O. Reg. 332/12 was revoked on 1 January 2025.

The Fire Code is easier: O. Reg. 213/07 is on e-Laws, consolidation period January 1, 2026 to the e-Laws currency date of August 12, 2026, last amended by O. Reg. 303/25.

The article number moved. Smoke alarms are 3.2.4.20 in the 2024 Code. Under the revoked O. Reg. 332/12 they were 3.2.4.22 — the whole range shifted by two. An old document citing 3.2.4.22 for smoke alarms is not wrong, it is just old. More on that in which ULC edition applies.

The smoke alarm rules: Building Code 3.2.4.20

Sentence (2), verbatim:

Except as permitted by Sentence (10), smoke alarms conforming to CAN/ULC-S531, "Standard for Smoke Alarms," shall be installed in each dwelling unit and, except for care, care and treatment or detention occupancies required to have a fire alarm system, in each sleeping room not within a dwelling unit.

The rest of the placement rules are short and worth knowing cold:

  • (3) At least one smoke alarm on each storey and mezzanine of a dwelling unit.
  • (4) On any storey containing sleeping rooms: one in each sleeping room, and one between the sleeping rooms and the rest of the storey — in the hallway, if a hallway serves them.
  • (6) Installed on or near the ceiling.
  • (13) Installed in conformance with CAN/ULC-S553.
  • (12) Where more than one is required in a dwelling unit, they must be interconnected so that one sounding causes all of them within that dwelling unit to sound.

Power: hardwired, no disconnect switch, 7 days plus 4 minutes

Sentence (9), verbatim:

Except as permitted by Sentence (10), smoke alarms referred in Sentence (2) shall (a) be installed with permanent connections to an electrical circuit, (b) have no disconnect switch between the overcurrent device and the smoke alarm, and (c) in case the regular power supply to the smoke alarm is interrupted, be provided with a battery as an alternative power source that can continue to provide power to the smoke alarm for a period of not less than 7 days in the normal condition, followed by 4 minutes of alarm.

Three separate requirements in one sentence: permanent connection, no disconnect switch between the overcurrent device and the alarm, and a battery good for 7 days standby plus 4 minutes in alarm. If you are installing to this, clause (b) is the one that gets caught on inspection.

Silencing, sound pattern, and strobes

  • (14) A manually operated silencing device must be built into the circuitry of a smoke alarm in a dwelling unit, silencing the signal for not more than 10 minutes, after which it resets and sounds again if smoke is still sufficient to reactuate it.
  • (16) The sound pattern must (a) meet the temporal patterns of alarm signals, or (b) be a combination of temporal pattern and voice relay.
  • (17) A visual signalling component is required, conforming to the requirements in 18.5.3 (Light, Color and Pulse Characteristics) of NFPA 72.
  • (18) That visual component need not be integrated with the alarm provided it is interconnected to it, need not be on battery backup, and need not have synchronized flash rates, when installed in a dwelling unit.
  • (19) In sleeping rooms, the luminous intensity must be a minimum of 175 cd.

A word on Sentence (17). NFPA 72 is an American standard, and it is not general authority for anything in Canada. It binds here only because Ontario's own Sentence 3.2.4.20.(17) points at one clause of it for one component characteristic. That is the whole of its force in this article. Do not extend it. The same distinction applies to product marks — see ULC vs UL.

The exception that creates the confusion: Sentence (10)

This is the sentence that lets a detector do a smoke alarm's job, and it is the reason the two words get used interchangeably on site. Verbatim:

(10) Suites of residential occupancy are permitted to be equipped with smoke detectors in lieu of smoke alarms, provided the smoke detectors (a) are capable of independently sounding audible signals with a sound pressure level between 75 dBA and 110 dBA within the individual suites, (b) except as permitted by Sentence (11), are installed in conformance with CAN/ULC-S524, "Standard for the Installation of Fire Alarm Systems," and verified in conformance with CAN/ULC-S537, "Standard for the Verification of Fire Alarm Systems," (c) form part of the fire alarm system, and (d) are equipped with visual signalling components that meet the requirements of Sentences (17) to (19).

Four conditions, and every one of them changes the job:

  1. 75 to 110 dBA within the suite, sounding independently.
  2. Installed to S524 and verified to S537 — not S553, and verification is now in scope. What that verification involves is set out in S537 verification.
  3. Part of the fire alarm system. Which pulls the device into the Fire Code's system regime, not the smoke alarm regime.
  4. Visual signalling components to the same Sentences (17) to (19).

Two relaxations follow. Sentence (11) permits these detectors to sound localized alarms within individual suites and states they "need not sound an alarm throughout the rest of the building." Sentence (15) says suites equipped this way need not have the manually operated silencing device that Sentence (14) requires for smoke alarms.

Different standards entirely — that is the whole point

Building Code Table 1.3.1.2 names the documents. The split is clean:

A smoke alarm is an S531 product installed to S553. A smoke detector on a system is an S524 installation verified to S537. There is no overlap between those two pairs. Which standards cover what is broken down in S524, S537, S536 and S1001 explained.

Fire Code: where the duties come apart

Installation is the Building Code. What happens for the next thirty years is the Fire Code, and this is where treating the two devices as the same thing gets somebody in trouble.

Smoke alarms — Subsection 6.3.3

Scope, Article 6.3.3.1.(1), verbatim:

This Subsection applies to smoke alarms in (a) suites of residential occupancy, (b) guest suites, (c) sleeping rooms not within a dwelling unit, and (d) other occupancies in which smoke alarms are required by the Building Code.

That last line is the one to sit with. The Fire Code says how to test a smoke alarm, and the method is: press the button. It names no standard, no instrument, and no qualification.

Smoke detectors — Article 6.3.2.2

Verbatim:

a fire alarm system, with or without voice communication capability, shall be inspected and tested in conformance with CAN/ULC-S536, "Standard for Inspection and Testing of Fire Alarm Systems".

Note what 6.3.2.2 does not say: it states no frequency. It delegates the entire procedure to S536, a paywalled standard. The word "annual" comes in from Article 6.3.2.1 and from Division C 1.2.1.1, not from 6.3.2.2 itself. The difference between that annual work and a one-time verification is covered in verification vs annual inspection.

And who is allowed to do it

Fire Code Division C 1.2.1.2.(1): a person carrying out annual tests or inspections under 6.3.2.2, or repairing, replacing or altering fire alarm components, must have "successfully completed a program or course acceptable to the Fire Marshal," and must produce on request "a copy of a certificate or document attesting to the successful completion of a program or course."

CFAA is not named in the regulation. The regulation says "acceptable to the Fire Marshal" and nothing more specific. Who may do what, and on what basis, is set out in who can work on fire alarms in Ontario.

So here is the contrast in one line. Testing a smoke alarm is a landlord pressing a button, annually and on turnover. Testing a smoke detector on a fire alarm system requires a person holding a Fire-Marshal-accepted program, following a standard you have to buy. Two devices that look identical from a stepladder.

A third category: interconnected smoke alarm systems

There is a middle case, and it has its own rules. Fire Code Article 6.3.2.6 applies to interconnected smoke alarm systems in all residential occupancies and care occupancies, except in individual dwelling units and in buildings regulated by Section 9.8. These are smoke alarms — not detectors on a fire alarm system — but wired together across a building.

Fire Code Table 1.2.1.A designates CAN/ULC-S552-14 for this work, and Division C Subsection 1.2.2 sets its own qualification rule — again, "a program or course acceptable to the Fire Marshal."

A weekly power check and a monthly rotational test is a far heavier regime than Subsection 6.3.3, and it applies to devices that are still smoke alarms. If you inherit a building with interconnected smoke alarms and treat it as a 6.3.3 building, you are missing 52 power checks and 12 tests a year.

A fourth: residential fire warning systems

Building Code Table 1.3.1.2 designates CAN/ULC-S540-13, "Standard for Residential Fire and Life Safety Warning Systems: Installation, Inspection, Testing and Maintenance," referenced at Article 3.2.4.21.(1).

Fire Code Article 6.3.2.7 closes the loop: smoke detectors that form part of a residential fire warning system and are used in lieu of smoke alarms "shall be treated as smoke alarms" for maintenance purposes. So the device is called a detector, sits on a warning system, and is maintained under the smoke alarm rules. Read the sentence, not the name on the housing.

The in-suite range is a bracketed pair with both ends stated — the only place in this subject area where you get a ceiling and a floor in the same clause. The full picture on levels is in fire alarm audibility in Ontario.

Two things Ontario added that the national code does not have

Retirement homes. Sentence 3.2.4.20.(20), verbatim:

Smoke alarms required in suites in a retirement home or smoke detectors permitted to be installed in lieu of smoke alarms as provided in Sentence (10) shall upon actuation provide an audible and visual signal to staff serving those suites, so that the suite containing the actuated smoke alarm or smoke detector can be easily identified.

NBC 2020 has no retirement home provision. This one is Ontario's. It applies to both device types, and it requires more than a sounder: staff annunciation, audible and visual, identifying the specific suite. If you are designing a retirement home from the national code, this is the clause you will miss.

The NFPA 72 pointer. Sentence (17) is the one place in this article where Ontario's Building Code sends you to an American document, and only for the light, colour and pulse characteristics in clause 18.5.3. That is the extent of it.

What we are not going to tell you

Detector spacing, how smoke enters a chamber, sensitivity testing methods, and how a device is addressed on a loop are all real questions and none of them are answered in the Building Code or the Fire Code. They live inside CAN/ULC-S524, CAN/ULC-S531 and CAN/ULC-S536 — all paywalled standards.

Are a smoke alarm and a smoke detector the same thing?

No. A smoke alarm is a self-contained device that senses smoke and sounds an audible signal at the device itself. A smoke detector is an initiating device that forms part of a fire alarm system. They are built and installed to different standards — CAN/ULC-S531 and S553 for smoke alarms, CAN/ULC-S524 and S537 for detectors on a system — and once in service they fall under different parts of the Fire Code. Everyone on site uses the words interchangeably. Ontario law does not.

Can a smoke detector replace a smoke alarm in an apartment?

Yes, under Building Code Sentence 3.2.4.20.(10), and only if four conditions are met. Suites of residential occupancy are permitted to be equipped with smoke detectors in lieu of smoke alarms provided the detectors sound independently between 75 dBA and 110 dBA within the suite, are installed in conformance with CAN/ULC-S524 and verified in conformance with CAN/ULC-S537, form part of the fire alarm system, and have visual signalling components meeting Sentences (17) to (19). Sentence (11) then permits them to sound only within the suite rather than throughout the building, and Sentence (15) says the 10-minute silencing device required for smoke alarms is not needed.

Who is allowed to test a smoke alarm, and who tests a smoke detector?

Different people. For smoke alarms in a rental suite, Fire Code 6.3.3.8 puts the duty on the landlord — annually, after every change in tenancy, after a battery is replaced, and after any change to the electrical circuit — and Sentence (5) says the test is done by activating the smoke alarm test feature. No qualification is stated. For a smoke detector on a fire alarm system, Article 6.3.2.2 sends you to CAN/ULC-S536, and Division C 1.2.1.2.(1) requires the person doing annual tests or inspections, or repairing, replacing or altering components, to have successfully completed a program or course acceptable to the Fire Marshal and to produce a certificate or document on request. CFAA is not named in the regulation.

Do smoke alarms have to be hardwired in Ontario?

Where a smoke alarm is required by Building Code Sentence 3.2.4.20.(2), yes — unless the Sentence (10) detector option is used instead. Sentence (9) requires permanent connection to an electrical circuit, no disconnect switch between the overcurrent device and the smoke alarm, and a battery as an alternative power source able to power the alarm for not less than 7 days in the normal condition followed by 4 minutes of alarm. The no-disconnect-switch clause is the one most often missed.

How often does a smoke alarm have to be replaced?

Fire Code 6.3.3.7.(1) says a smoke alarm shall be replaced within the time frame indicated in the manufacturer's instructions. The Fire Code sets no fixed number of years of its own — the interval comes from the product literature for the specific alarm. That is also why 6.3.3.4 requires the landlord to give the tenant a copy of the manufacturer's maintenance instructions or approved alternative instructions.

What about smoke alarms that are wired together across a building?

Those are interconnected smoke alarm systems and they have their own regime under Fire Code Article 6.3.2.6, applying in all residential and care occupancies except individual dwelling units and buildings regulated by Section 9.8. They are tested and maintained to CAN/ULC-S552: the power supply is checked weekly, operability is confirmed monthly by testing at least one alarm on a rotational basis, any manual pull stations are tested annually, and written records of the weekly power checks are kept at least six months and produced on request to the Chief Fire Official. Fire Code Division C Subsection 1.2.2 sets a separate qualification rule for this work, again a program or course acceptable to the Fire Marshal.
